Terms and Conditions

The terms “you” and, “your” shall mean you the participant who is participating and competing in any or all of the activities described in this web site, commonly identified as the Pala Raceway Freestyle Amateur
The term “AFMXA” shall mean the American Freestyle Motocross Association, a Nonprofit Corporation.

The term “Event” shall mean any and all activities associated, or related, directly or indirectly with the Pala Raceway Freestyle Amateur presented by the AFMXA and hosted by the Pala Raceway, including, but not limited to your activities relating to performing any Freestyle Motocross aerial maneuver, and the posting of the URL’s to the YouTube web site.

By agreeing to these Terms & Conditions, you acknowledge and agree:

1. That the sport of Freestyle Motocross is an inherently dangerous sport that involves the risk of serious personal injury, illness, permanent disability, dismemberment and death, and that also involve the risk of severe economic and property loss and damage. Further, that you understand that these risks may result from the actions, negligence, fault, omission and failure to act of yourself and others. You assume all of the foregoing risks including the risk of any negligence by the AFMXA, if any, and any other participants or by Event organizers, sponsors or volunteers of the AFMXA and its respective directors, officers, employees or agents, and accept personal responsibility for any injury (including, but not limited to, personal injury, disability, dismemberment and death), illness, damage, loss, claim, liability or expense, of any kind or nature, that you or your property may suffer arising out of or in connection with your participation in the competition or activities described on this web site or associated with the Event.

2. You are physically fit to participate in the Event in which you have chosen to participate, and have not been advised otherwise by a medical practitioner.

3. You will, before participating in the Event, inspect the related facilities and equipment. And, that you will refuse to participate in the Event until all unsafe conditions observed by you have been remedied.

4. You agree to wear protective equipment and will ensure that at all times you will wear the appropriate protective equipment during practice sessions and competition as a reasonably prudent participant would wear.

5. You hereby release and forever discharge and agree to save and hold harmless the AFMXA and its respective organizers, directors, officers, employees and volunteer, and agents of all of them, (each such entity or individual being referred to as a “Released Party”) of and from any and all injuries (including personal injury, disability, dismemberment, and death), illness, losses, damages, claims, liabilities or expenses (including attorneys’ fees) of any kind or nature accruing to you, your heirs or your personal representatives that are caused or alleged to be caused in whole or in part by your action, negligence, fault, omission, failure to act, or by your breach or alleged breach of this Waiver and Release, that arise out of or in connection with the AFMXA or my participation in the Event.

6. This Waiver and Release and all disputes arising under this Waiver and Release brought by the individual agreeing hereto, or by such real party in interest, Executor, Administrator, or assign, shall be governed, construed and decided in accordance with the laws of the State of California.

YOU HAVE READ AND UNDERSTAND THIS WAIVER AND RELEASE OF LIABILITY AND NAME AND LIKENESS RELEASE. YOU UNDERSTAND THAT BY AGREEING TO THIS WAIVER AND RELEASE, YOU HAVE GIVEN UP SUBSTANTIAL RIGHTS. YOU HAVE VOLUNTARILY AGREED TO THIS WAIVER AND RELEASE AND ALL OF ITS TERMS BY AFFIRMATIVELY SELECTING THE “I AGREE TO THE TERMS & CONDITIONS” BUTTON ON THIS WEB SITE.

IF THE PERSON PARTICIPATING IN THE EVENT IS UNDER THE AGE OF EIGHTEEN YEARS (18) (A MINOR), THE SECOND BUTTON STATING “I AGREE TO THE TERMS & CONDITIONS” MUST BE SELECTED BY THE PARENT OR LEGAL GUARDIAN OF THE EVENT PARTICIPANT, WHICH PARENT OR LEGAL GUARDIAN, BY SELECTING SAID BUTTON DOES REPRESENT, UNDERSTAND, AND AGREE AS FOLLOWS:

1. I represent that I am a parent or legal guardian of the minor who has agreed to the terms of the above Waiver and Release, and that I have the legal authority to agree to the terms hereof. I hereby consent to the terms of the above Waiver and Release, and agree that I, on behalf of my self and the minor, shall be bound thereby.

This Waiver and Release is by and between the Released Party, the participant/competitor, and the parent or guardian of any participant/competitor who is a minor. It shall not be construed as a Waiver and Release of any other nonparties and may not be asserted or introduced by any nonparty as a Waiver or Release therefore.
